I hear ya. But I believe they did wait for a first office action in both the 148 and 584. One must wonder if they were really at risk of losing the opportunity to add the claims. Of course, this is working against my theory that a 336 cert is emminent. If they thought that, I believe we would see a request for ammendment. Since we have not seen any, that could mean no cert is actually emminent.

IMHO Moore would add claims to the 336. Like you said. It is an opportunity. Use it or lose it. Shot myself in the foot again.
