As we all know, we are in the dark on what the company is or is not doing as the shareprice sinks. There are 2 potential theories on what is going on:

1. Negative. Whatever is going on behind the scenes is not in the shareholders best interest. To subscribe to this theory one has to believe that the BOD is just finding ways to line their pockets while putting on a front of that they are trying to enhance shareholder value. There is no basis to believe the MMP is not valuable with over $200 million brought in already, but maybe ARM exposed some holes with the 584 and weakened the MMP. Low numbers for remaining J3 settlement reflects the company has resorted to nuisance value settlements and will continue to keep them confidential so other companies dont know. Shareprice may tank but BOD doesnt care because even a few million here and there will be enough money to line their pockets with fat salaries, benefits and perks.

2. Positive. Whatever is going on behind the scenes is in the shareholders best interest. As devastating as the confidentiality has been, there must be a long term benefit to it. There is an obvious lull right now but it is only the calm before the storm as the company is currently making moves regarding licensing and M&A that will come to light soon. It would make sense that no major licensing will happen this close to the USTPO review until after USPTO stamp of approval and no major M&A until Schwartz looses approval authority. It also makes sense that company has to be carefull what it can say publicly as it makes these moves.

I have wrestled with both theories and I believe the Positive is the more reasonable and logical theory. Of course I could be wrong, but I envy those who are getting in for the first time right now at these prices and I have already made sure I share in the appreciation with them.
