No case starts with 50/50 odds - every case is different, and typically the side that has present law in their favor has an advantage (if all else is equal - which we have no way of knowing). It takes a lot more for a judge or judges to overturn case law than to uphold it.
Even if it did start 50/50 that would be just for the parties involved - the effect on other companies would depend on too many variables to pinpoint it so saying 50/50 (even though your trying to start neutral) is even irresponsible.
