CALGARY, April 10 - Star Navigation Systems Group's ("Star") issued a press release dated April 10, 2008 stating "the United States District Court in San Francisco, California declined Aeromechanical Services' request to dismiss the patent infringement lawsuit filed by Star Navigation" (the "Star Press Release").
AeroMechanical Services Ltd ("AMA") feels that it is necessary that it clear any misconceptions that may result from the Star Press Release, specifically, in AMA's opinion, the inaccuracies of the statement above as contained in the Star Press Release.The decision of the U.S. District Court for the Northern District of California (the "U.S. District Court") specifically states the following:
"For reasons stated above, defendant's motion (AMA in this instance)to dismiss is herby GRANTED, and the First Amended Complaint is hereby DISMISSED, without prejudice to plaintiff's filling(Star in this instance), no later than April 30, 2008, a Second Amended Complaint, in which both inventors are named parties." Also in the Star Press Release, Star states "Originally, the infringement suit was brought by Star only; however, the inventors, Messrs. Kapadia and Vieira, who had previously authorized the litigation, will now be added as co-plaintiffs."
AMA again feels it is necessary that it clear any misconceptions that may result from the Star Press Release, specifically, in AMA's opinion, the inaccuracies of the statement made by Star above. In a complaint filed today with the Ontario Securities Commission and the TSX, a copy of which was forwarded to AMA, Mr. Hilary Vieira's attorney states the following:
“Mr. Vieira did not previously authorize the litigation, nor has he consented directly or implicitly to be added as a co-plaintiff. In point of fact, Mr. Vieira takes the position that Star Navigation Systems Group Ltd. has issued a false and misleading press release in this matter by stating that he was supportive of the litigation and that he is potentially a party thereto."
