CALGARY, Dec. 24 - AeroMechanical Services Ltd. ("AMA") announced today that Star Navigation Systems Group, Ltd. ("Star") has taken the extraordinary step of amending its complaint to withdraw several claims of infringement only months after it had asserted those claims against AMA in September 2007. Star's patent infringement case is now limited to allegations concerning the apparatus claims in the U.S. Patent No. 7,113,852 ("the '852 patent"). AMA has filed a second motion to dismiss the amended complaint filed by Star in the U.S. District Court for the Northern District of California.
AMA originally requested that Star's suit be dismissed on December 3, 2007. AMA does not believe that Star has legal standing to assert infringement of U.S. Patent No. 7,113,852 ("the '852 Patent") - at least because Star does not own the patent, the owners have not been joined as parties to the suit, and one of Star's co-founders, Mr. Hilary Vieira, has sued Star and alleged that Star no longer retains any rights to the patent.
Star avoided responding to AMA's motion on the merits by filing the Amended Complaint on December 18, 2007. AMA was therefore required to file a second motion to dismiss. AMA believes that this case will be summarily dismissed by the Court upon consideration of its motion.
AMA is a technology leader in airliner performance monitoring systems. As a patent holder, AMA takes intellectual property matters very seriously and respects the intellectual property of third parties. AMA is disappointed that Star has chosen to attempt to compete with AMA via press release, baseless litigation, and U.S. Patent Office procedure - rather than in the marketplace via better products and services.
"Recently announced contracts by operating airlines are further evidence that the commercial aviation industry views AMA's technology solutions as its preferred solution in their efforts to stimulate growth and improve efficiency" stated CEO Bill Tempany.
